The terms behind every build, in plain English.
Deposit and refunds, what you get and when, who owns what, and how the monthly plans work. Short on purpose, because the project plan carries the specifics.
The agreement
Every build starts with a short project plan: the pages, the price and the dates, sent to you before anything is charged. When you pay the deposit, that plan and these terms are the agreement between you and Loomwest (Andre Costa, Gilroy, California). Where the plan and these terms differ, the plan wins.
Payment
Half of the price to start, the rest when the site goes live. Zelle, PayPal or Venmo today; card payments through Stripe once it is set up. Prices are as published on this site at the time of the plan, and every price is fixed once the plan is agreed.
Deposits and refunds
The deposit is refundable in full until design begins. Once design begins, the deposit is earned and is not refunded; if you stop the project after that point, you owe nothing further and you keep whatever has been designed for you. If we fail to deliver what the plan promised, you get the money for the undelivered part back. Monthly plans are billed for whole months and are not refunded for part of a month.
What you get
The pages in the plan, written and built by Loomwest, checked on a phone, launched on your domain, with the search basics set up. The timeline in the plan (three, five or seven days depending on size) runs from the day we have your photos, your words and your sign-off on the draft; time spent waiting for material or for your review is not counted. For thirty days after launch, small changes are free: a price, a photo, your hours, a typo. After that, changes are covered by a monthly plan or quoted as a small job. Every site we host carries the same cookie-free visit counting, so your report can start the month you join a plan; the counts are yours, and we switch them off on request.
What we need from you
Photos, words and facts about your business, delivered when the plan asks for them, and a review of the private preview through the review form before launch. You confirm that what you give us is true and that you have the right to use it: your own photos, your own logo, and any material you supply or attach through a private page. Anything you attach stays private until it is on your site with your approval. Anything we source for you is licensed for your site. If you have an existing web address, access to the account where it is registered (as a delegate or added user, or on a short call where you make the change with us), so we can point it at your new site. Your email and anything else on that address are left as they are.
Ownership
Your domain, which is your web address, is registered in your name with your own billing. Once the build is paid in full, the finished site is yours: the files are handed over on request to take to any host or any other designer. Loomwest keeps the right to reuse the building blocks it made before your project and to show your site in its own work examples, unless you ask us not to. Hosting on our server is included while you choose to stay with us.
Monthly plans
The Care plan, the Managed plan, the Managed Plus plan and local ads management are month to month. The Managed and Managed Plus plans include unlimited content changes to existing pages; new pages and redesigned sections are quoted separately. Every site we host includes a short monthly report on its visits and taps: where they came from, the most viewed pages and taps to call, order, book or get directions, counted without cookies by GoatCounter and named on your site's privacy page, plus what we updated that month. Each is billed at the start of the month it covers and continues until you cancel; cancel any time by email before the next billing date and the plan ends at the end of the paid month. When a card is charged automatically, the renewal terms are shown and agreed at checkout, and an email confirms them. If a plan stops, the monthly work stops; the site stays online until the hosting term already paid for runs out, and the files are yours as above.
Yearly plans. The Care plan, the Managed plan, the Managed Plus plan and local ads management can also be paid a year in advance, at the price of ten months (for local ads, the management fee only; the ad budget stays monthly, paid by you to the platforms). A yearly plan runs twelve months from the day it is paid and renews only if you choose to pay again. If you cancel early, the months already used are charged at the regular monthly price and the rest of the payment is refunded.
Content Studio and ad management
The Content Studio plans (Starter, Growth and Pipeline) are month to month, at the prices published on the Content Studio & Ads page. Starting a plan online charges nothing: the request goes to Andre, who agrees a start date with you, and billing begins on that start date. From then on, each plan is billed at the start of the month it covers and continues until you cancel; cancel any time by email before the next billing date and the plan ends at the end of the paid month.
Each month includes the number of finished short-form clips in your plan (four on Starter, eight on Growth, twelve on Pipeline), cut from the footage you film and drop in the shared folder, plus the other items that page lists for your plan. On Starter you post the clips yourself; on Growth and Pipeline we schedule and post them for you. Every cut comes to your private review page first, with one revision round, and nothing is posted without your approval.
Local ad management covers building Meta and Google campaigns targeted by city, testing several ad versions against each other, and a plain-English report each month. It is billed and cancelled like the other monthly plans above. Your ad budget is separate from the management fee: it goes straight from your card to the platform, and Loomwest never touches it and cannot see it.
Custom motion ads, like the films shown on the Content Studio & Ads page, are not included in a plan or in ad management. Each one is quoted per project, and the quote you accept, together with these terms, is the agreement for that project.
Referrals
When someone you refer hires Loomwest for a website build, you both get the referral reward once their build is paid in full. It has two parts. First, one free month of the Managed Plus plan ($149 value). For the new client, it comes on top of the free first month of Care that every build includes. If you are not on a monthly plan, your free month is a trial month: it ends on its own, and nothing is billed unless you choose to continue.
Second, the option to pay for one year of the Care plan, the Managed plan or the Managed Plus plan at half its yearly price: $295 for Care (instead of $590), $575 for Managed (instead of $1,150) or $745 for Managed Plus (instead of $1,490). That year must start within 60 days after your free month ends. It is paid in full up front and otherwise works like the yearly plans above: it runs twelve months from the day it is paid and renews only if you choose to pay again, at the regular yearly price.
To refer someone, tell us their name, or have them mention you when they get in touch: by phone, by email, or in the notes box on the order page.
What we do not promise
We build for search and set up every basic Google looks at; nobody can promise a ranking, and we do not. We are not responsible for what third-party services you use (booking, ordering, payments, email) do on their own systems. Our liability for anything arising from a project is limited to the amount you paid Loomwest for that project.
Law, ending the agreement, and the fine print
These terms are governed by the law of California. If something goes wrong, we talk first; either of us can end the agreement by email if the other breaks it and does not fix it within fourteen days of being told. If a part of these terms turns out to be unenforceable, the rest still stands.
